By accessing or using the Braininess Academy website (https://braininess.in) or enrolling in any of our programs, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, please do not use our services.

These Terms constitute a legally binding agreement between you and Braininess Academy. We reserve the right to modify these Terms at any time, with notice provided on our website. Continued use of our services after modifications constitutes acceptance of the updated Terms.

Braininess Academy provides educational programs including Abacus Training, Mental Mathematics, Vedic Mathematics, Brain Development, and Memory Enhancement for children aged 4–14. Our services are delivered through:

• Physical centers operated by Braininess Academy or licensed franchise partners.
• Online live interactive sessions via our digital platform.
• Self-study resources including our app, workbooks, and digital tools.

We reserve the right to modify, suspend, or discontinue any service with appropriate notice to enrolled students.

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the confidentiality of your account credentials.
• Notify us immediately of any unauthorized use of your account.
• Take responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

Fees: Program fees are due at the time of enrollment and are payable as specified at your enrollment center. Fees vary by program, location, and batch type.

Refund Policy:

• If you are not satisfied after your first month, we provide a full refund of program fees — no questions asked.
• After the first month, no refunds are provided for the current month's fees already paid.
• Enrollment kit (abacus, workbooks) fees are non-refundable once dispatched.
• For online programs, refunds are processed within 7 business days.

All content on the Braininess Academy website and in our programs — including but not limited to the BrainBoost™ curriculum, course materials, videos, workbooks, brand assets, and software — is the exclusive intellectual property of Braininess Academy and is protected by Indian and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, or commercially exploit any of our content without explicit written permission from Braininess Academy.

When using our services, you agree NOT to:

• Reproduce, share, or distribute our proprietary curriculum or course materials.
• Record or screenshot our online sessions without written permission.
• Use our brand name, logo, or trademarks without authorization.
• Engage in any activity that disrupts or interferes with our services or other users.
• Submit false or misleading information in enquiry or enrollment forms.
• Harass, threaten, or abuse our staff, trainers, or other students/parents.

Our programs are designed to support children's cognitive development and are based on established educational and neuroscientific research. However, we make no guarantee of specific academic outcomes or grades. Individual results vary based on the child's age, starting level, practice consistency, and other factors.

Our website and information are provided "as is" without warranties of any kind, express or implied, including but not limited to accuracy, completeness, or fitness for a particular purpose.

To the maximum extent permitted by applicable law, Braininess Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use our services.
• Any errors or omissions in our content or programs.
• Technical failures, service interruptions, or data breaches beyond our reasonable control.

Our total aggregate liability to you for any claim arising out of these Terms shall not exceed the amount paid by you for the relevant service in the three months preceding the claim.

These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra, India.

For disputes relating to franchise agreements, the terms of the franchise agreement shall take precedence. We encourage resolution of all disputes through amicable discussion before approaching legal remedies.
